Can a Beautician do Teeth Whitening?

The General Dental Council (GDC) has reported a sharp rise in reports of illegal teeth whitening within the last year. Last year 732 cases of illegal-teeth whitening were reported to the GDC, a 26% increase from 582 in 2018. The GDC said it had launched 126 prosecutions against illegal teeth whiteners since 2015.

Hair and beauty professionals are reminded that only a qualified dentist, or dental hygienist/therapist working to a dentist’s prescription, can carry out any teeth whitening procedures. 

Caroline Larissey, NHBF Director of Quality & Standards, said, “If you offer teeth whitening, you are breaking the law and your insurance will not cover you if things go wrong.  As well as a potentially huge claim for damages, you will also face unlimited fines for breaking the law. The NHBF provides a free factsheet for their Members to make sure they know all the facts about teeth whitening.”

“In addition, don’t be taken in by ‘training courses’ that offer ‘qualifications’ in teeth whitening. These can be expensive but are not worth the paper they’re written on,” says Caroline. “Only qualified dentists can legally carry out teeth whitening.”

The NHBF also advises salons not to sell legal home teeth whitening kits. “In theory, there is nothing to prevent a salon selling these kits,” says Caroline, “but it would be very tricky to do this without also offering advice on how to use them – and offering advice is against the law unless you have dental qualifications.”

Can Dental Nurses Sell Teeth Whitening?

In terms of treatment; the actual application of the bleaching gel to the teeth, the simple answer is no. The treatment is not included under Scope of Practice as a role for the nurse. The same applies to delegating to the nurse, the explanation of whitening treatment to prospective patients, which again is not mentioned in Scope of Practice guidance.

Only dentists can purchase bleaching gel and therefore only they, and hygienists and therapists who have had appropriate training and are working under the prescription and supervision of the dentist, can provide the ‘first cycle’ treatment as described above.

Additional bleaching gel can then be sold to the patient by the dentist, or hygienist or therapist, who was responsible for that course of treatment. It cannot be sold to the patient, either at the start or at any time in the course of the treatment, by other team members. This includes dental nurses.

Shade review and intra-oral photography

Scope of Practice confirms that dental nurses can develop the skills of shade taking and intra-oral photography, after appropriate training. These skills can then be used to review and record the progression of whitening treatment.

Construction of bleaching trays

Scope of Practice also states that dental nurses can construct mouth guards and bleaching trays, to the prescription of a dentist, again after appropriate training. Moreover the Medicines and healthcare products Regulatory Agency (MHRA) have clarified that dental bleaching trays do not fall within the remit of the Medical Device regulations (see www.mhra.gov.uk).

This means that there is no requirement to provide a custom-made statement for those trays. There is then also no requirement for the practice to register with MHRA unless the practice also makes other custom-made devices onsite.

The dental nurse can have a valuable role in the provision of whitening, as an expansion of her/his skills, following the necessary further training.

This is often referred to as “four handed dentistry” and may only be performed while the dentist is physically attending to the patient with the dental assistant.

An unlicensed dental assistant may not perform any supportive service while the dentist is not physically present at the chairside and attending to the patient.

To be licensed, a person must:

  • Be at least 18 years of age;
  • Submit an application, fee and all required documents;
  • Meet education requirements; and

In addition to meeting the examination requirement, an applicant must meet the education requirement. The education requirement for a license is (1) possession of a high school diploma (or its equivalent) and (2) completion of a program in dental assisting that the New York State Education Department has registered (approved) as leading to licensure or is accredited by an accrediting agency acceptable to the Department or that the Department has determined is the equivalent of such a registered or accredited program.

The program must be adequate to prepare a student for the practice of registered dental assisting, as defined in section 6608 of Education Law. It must be either:

  • A one-year program consisting of 24 semester hours (or the equivalent) that includes all of the following components.
    1. the biomedical sciences area, including:
      1. body structure and function,
      2. basic concepts of microbiology pertaining to infection control,
      3. basic nutrition; and
    2. the professional dental assisting components area, including:
      1. dental materials and instruments,
      2. dental radiography techniques and safety,
      3. basic dental and oral anatomy,
      4. introductory content in oral histology, embryology, pathology, and therapeutics,
      5. legal and ethical aspects (dental record keeping, terminology, charting, and patient confidentiality); and
    3. the clinical content area, including:
      1. chairside dental assisting and appropriate laboratory procedures, which includes
        1. placing and removing temporary restorations
        2. placing, condensing, and carving amalgam restorations
        3. placing, condensing, and finishing non-metallic restorations,
      2. patient education and preventive dentistry,
      3. dental radiographic procedures,
      4. infection control,
      5. assisting in management of dental and medical emergencies; and
    4. course work in oral and written communications and basic behavioral concepts
    5. at least 200 hours of clinical experience.
    Or
  • An alternate course of study in registered dental assisting acceptable to the New York State Education Department that includes:
    1. the biomedical sciences, professional dental assisting, and the clinical content areas; (as described above) and
    2. at least 1,000 hours of relevant work experience in the practice of registered dental assisting under a licensed dentist’s direct personal supervision, to begin after enrollment in the program.
